Posted at 13:42h, 01 JulyI don’t think Johnson v. California should be included among the 13 Ninth Circuit reversals listed on the Circuit Court Scorecard. Johnson was a case from the California Court of Appeal, not the Ninth Circuit.
G&H responds: You’re right that No. 04-6964, Johnson v. California, hails from the California Court of Appeal. However, the Circuit Scorecard is referring to another Johnson v. California: No. 03-636, in which the Ninth Circuit was reversed.
